Division Street Manufacturing strives to offer our customers the highest quality products available. Therefore, Division Street Manufacturing warrants its new products to be free from defects in material and workmanship for the duration of 60 days from the date of the original purchase. If you believe you have received a defective product, simply follow the instructions below.
Division Street Manufacturing does not warrant products which are damaged as a result of improper use.
Division Street Manufacturing is the sole and final judge of whether a product is covered by the warranty. In the event that Division Street Manufacturing determines that a defect in material or workmanship exists, Division Street Manufacturing’s responsibility is strictly limited to the replacement of the product and the return of the product with shipping prepaid. Division Street Manufacturing has no other obligation, and makes no other warranties – whether express or implied.
As used herein, the term “Purchaser” shall mean the original purchaser of the Division Street Manufacturing product. The Limited Warranty is restricted to the Purchaser. The warranty is not assignable or otherwise transferable.
DIVISION STREET MANUFACTURING PROVIDES NO WARRANTY EITHER EXPRESS OR IMPLIED OTHER THAN THIS LIMITED WARRANTY. DIVISION STREET MANUFACTURING EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF ANY KIND INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT SHALL DIVISION STREET MANUFACTURING OR ITS AGENTS, OFFICERS, DIRECTORS, EMPLOYEES, OR SUCCESSORS BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF, OR IN CONNECTION WITH, PRODUCTS OR SERVICES SOLD, WHETHER BASED IN WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), OR ANY OTHER LEGAL THEORY. DIVISION STREET MANUFACTURING ’S Maximum LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT.
DIVISION STREET MANUFACTURING neither assumes, nor authorizes any other person to assume for us, any other liability in connection with the sale of DIVISION STREET MANUFACTURING productS.
Any implied warranty determined to be applicable is limited in duration to the duration of the Limited Warranty described above.
This Limited Warranty gives you specific legal rights. However, you may also have other rights that may vary from state to state or province. This Limited Warranty constitutes the entire understanding between Division Street Manufacturing and the Purchaser.
In order to exercise this Limited Warranty, the Purchaser must: (1) return the defective product to Division Street Manufacturing; (3) supply the dated purchase receipt; and (3) provide a clear description of the problem. At this point, Division Street Manufacturing will determine if a defect in material or workmanship exists. If the warranty claim is approved by Division Street Manufacturing, the product will be exchanged for a new product. Warranty claims will be rejected if the Purchaser cannot establish the date of purchase.
